    SC Cleared but failed BPSS

    Hi

    Advice gents, went for a role at HMRC but failed baseline a check due to me declaring a 7 years ago incident of "obtaining property by deception" basically I knowingly brought stolen goods, I was so guilty I admitted it and paid back the shop that lost out in full at my own loss, not looking for sympathy it was my own wrong doing!

    I subsequently have been SC cleared by declaring this information since 2008 up until 2020

    how can I fail BPSS in that case? this offence is what they didn't like so the agency tells me, it's left me looking like a div as I handed in my notice as I had a start date scheduled, is their anything I can do?

    There is no appeal, sadly. The judgements are made by individuals, not rules. Bit of a bugger but little you can do about it. It may even be that you didn't fail on the basis of your previous record, but you will never know.

      Squirm and ask for your old contract back, you feel bad letting the client down and happy to stay for another year - etc etc

      What were you thinking handing in notice without 1st getting Cleared - man alive

        SC and DPSS are different processes, looking for different things.

        SC is much more concise - so it is expected that they will find stuff, therefore they tend to have more leeway about minor stuff they do find, as long as you were upfront about it.

        DPSS and CRB tend to be a bit more automatic - they find something - anything - fail...

          My understanding was baseline is a lower check and I was given the provisional start date by the agency, I just assumed being SC would be ok and doing baseline would have been a formality even if I did have a blemish, gutted

          The people doing the check even said it was due to this offence

            the first step in SC is a BPSS check, basically an ID and solvency test. If your SC is still live there's no way you fail BPSS.

              Certain government agencies and public sector bodies won't take people on to their projects with certain convictions even though they will pass SC.

              I knew someone who couldn't do some work for the police due to one of his driving convictions but had no problems being SC cleared to do other work.

                You dont get charged with obtaining property by deception for handling stolen goods, you get chraged with the aptly named handling stolen goods, something dont ring true here.

                  Bearing in mind he needs to be sponsored for his SC he may not have been able to get it unless he was in a position to take a gig and to start the process for SC. Something he might not have been able to do while he was still in a job...........

                    Doesn't really matter as while one is a case of fraud and the other is theft, no business or organisation that deals with finance will want to touch you.
