    end of contract bonus

    Evening people

    First post so be gentle

    I just completed contract last month , was initial 12 months , then took 12 months extension . on the extension contract , a 3 % bonus of yeary salary was written in , but was not stated on the original contract .
    Now ive been demobbed , the agency are only offering to pay me 3 % of my last 12 months salary , not the first 12 months. Should the extension contract terms supercede the original one ? i.e. the 3 % bonus would therefore apply to both years salary ?

    The bonus probably only applies to the second year. But without seeing the actual contract, it's impossible to tell. Even then, it's probably ambiguous.

    Are you a contractor or were you on a fixed-term employment contract.

      I would expect a bonus only on the latter 12 months. The original contract has no mention of a bonus, only the extension. I assume the client changed the conditions.

        I know contracts can be confusing but this seems about as black and white as it can get.

        Old contract, no mention of bonus. New contract, mention of bonus. Which contract period do you think the bonus applies to? The first or the second?

          You are going to need this bonus to pay your PAYE and NI when you get found out to be inside IR35 IMO...

          You do not earn a salary from your client... permies earn salaries, contractors do not. 3% of nothing is nothing so you are sorted. Simple.

          Can't even be bothered to go in to the other failures in this post so will leave it at that.

            He might be an employee on a fixed term contract and have got his terms mixed up?
