However, from reading a few posts on here it does seem to happen near the end of the contract when the client wants rid of early. With MOO obviously, they can give you your notice but then tell you not to come in anyway so notice period seems to be a bit academic? Am I right here?
Thanks for your valuable input again but the client doesn't want to get rid early, they are enforcing 10 days off for contractors. As I already pointed out it is unfortuante in this case it is at the end and does not mean they have engineered it to work like this. Please read the comments a little better.

Yes you are right though. Notice is worthless in contracts.

Cant see too many clients telling you mid-contract, take a month off then come back for next project. Surely this would be a sure fire way to piss your contractors off and risk them telling you to stuff it and go off and do something else. After all, it works both ways.
Thats right. It is very bad business.

Then again, I used to work as permie in a place that made the contractors all take 3-4 weeks off for Xmas every year. Some reason about cost cutting and less work gets done in decemember etc. Personally, I though it was all a bit silly and just managed to piss them off to save a few quid. There were times when something important had to be done by one of the contractors in december but company policy dictated they couldnt work.
That is probably because you don't have a clue.

Having a similar thing with my current clientco. It seems that the contractors that work through the large consultancies are being forced to take 10 days off next month however the direct or agency contractors are being asked to take a few extra days off but it's optional.

It's going to be very quiet here during the Christmas week with almost no perms on the floor i'm on but i'll be here invoicing

I'll just be pedantic and point out that without MOO they can give you your notice but then tell you not to come in anyway.
With MOO they can not do this.

That is obvious if you bear in mind what MOO actually stands for.

SO you invoice for an extra week. So around a 2% increase in revenue (assume 1 year contract) and expose yourself to taking a 40% hit as it'll be easily proved the whole contract was one of service not for service .... i.e. Hector will treat you as an employee.

          Smart business move that.
His call (if you look I also said I wouldn't personally let it go).

Does seem a lot of fuss for 5 days money, however.

It's nothing to do with agreeing. You made a point that wasn't right and also had been corrected a few posts previously.

If I wasn't rude I would probably cease to exist which would suit a lot of people I am sure but thats a discussion for another day.

The rudeness on this forum is a real shame as there are some people with valuable experience and knowledge. Sometimes its not "what you say" but "how you say it"

Like I said its quite within your rights to disagree with me or even think it but its a bit out of order to be so offensive.

This is very true and am often very guilty of this but it is a two way street, if you don't want a rude remark don't make yourself look like a pillock when you post. If it walks like a duck.. etc... Some posters have to think a bit before they post. This is a professional forum, not mumsnet.

Am not going to go on as this is offtopic. I am in the wrong quite often I admit but I am not the source of the problem and am also not the only one who deserves blame.

Now no more crying and lets get back on topic....

                      OK. Back on topic.

Please explain why you dont agree with my feelings that making contractors take a long xmas holiday is not going to upset them. would you be a little upset?
