    notice period ????

    have reccently been working a contract for 7 weeks on 11ph. have just been offred another 6mth contract for 18ph.current agency have told me i need to give TWO weeks notice ??????apprently to give them chance to find someone else.??

      well can they hold me to this.obvisouly want to start this new contract monday.
      have said i will be leaving on fri in any case

          well i only signed a contract from my umbrella company and that doesnt mention notice period. ive had people end contracts on me (through no fault of mine) at short notice so works both ways.

            They can hold you to whatever the contract says. Read it carefully and see whether you are breaching the contract or not.

              have since looked at my contract and its is a week.

              'During your first 2 years' continuous Employment the period of notice you are required to give the Company is 1 week and thereafter will increase to 4 weeks. You may be permitted to leave earlier by agreement'

                    does it have a right of substitution clause in it? if so, advertise the job for immediate start, 1 weeks contract work in ... etc.

                    once you've found someone suitable, BEFORE taking on the new contractor, give the details to the end client and tell them you are using your right to substitution, contractor xyz will be here for MyCo's final weeks work etc. etc. They wont like it and will most likely tell you they dont want contractor xyz and agree to terminate the contract early. Your in the clear, contractor xyz gets a "sorry position is no longer available as client cancelled contract" and you are acting like a true business.

                    you DO have a right of substitution clause don't you? or are you effectively a permie in disguise?
