I understood that charging commission to find employment is illegal. See Bigbird's post here:
http://forums.contractoruk.com/threa...ommission.html which has a link to DTI guidance. Any ideas anyone?

IMHO: BITE looks dodgier than DodgyAgent paying for dodgy knock-off gear with a 3-pound note, and seeking tax relief on the transaction.

Obviously dodgy, but what about illegal?

A fundamental principle of the Employment Agencies Act is that workers cannot be charged for work finding services. The exceptions to this are the entertainment and modelling sectors. Please telephone the enquiry line on 0845 955 5105 if you have a query relating to this area.

So, as naughty as can be. Unless BITE is running an "IT Contractor, Cruise Singer & Catalogue Model" scam!

Are they able to charge if you opt out?

Good question. I'd say yes, but more expert opinion than mine currently disagrees. If we could though, that opens a whole new way of working...

To me it would imply that we can't really opt out if you are unable to pay somebody to find you work once you have opted out. That could have all sorts of implications further down the road......

Found an interesting article on ITC that seems to shed some light on who can be charged etc (read the comments bit at the bottom):

                  http://www.itcontractor.com/Articles...74&photopage=0

seems I can't post a link to that site... but if you go to i t contractor . com - it's an article titled: "Cynanto – the IT contractor directory. Cut out the Agency"

This is a new one on me, I am aware that certain recruitment agencies are suggesting that they will have to pass on additional administration costs directly to clients where there are additional administrative requirements for managing contractors who have 'OPTED IN' to the Agency Regulations, but never to 'OPT OUT'. You would expect this to be handled in the form of a general increase in fees with a discount for those contractors who have opted out. As a result some clients may avoid the additional costs and have a preference to those limited company contractors who have opted out of the EAA Regulations, hence why you are supposed to OPT IN or OUT of the regulations before your details are actually submitted to the end client...
