    Can you be canned for being sick?

    All,

    I was off last week for 2 days and this week for 2 days, I sent a mail to my manager explaining that I had what was probably the worst case of flu for the last 4-5 years.

    Came into work yesterday, and client is thinking of canning me for lack of output (my project is on hold till 6/1/09) and they are aware of the reasons why, and because they are worried aboout my excessive sick leave?

    Eh?

    Can they do this?

        So in theory they could give 4 weeks notice on 31st Dec : but in practice I suspect they are giving you a warning shot across the bows. If they were going to terminate they would just have done it.

        Just apologize and say you will make sure you turn up.

          Sorry to hear of your plight.

          Repeated Illness can be grounds for termination - however they normally look at your absences over a year - and normally you will be given a written warning expressing concern.

          HR depts are cracking down on 'sickies' - I thin the aim is for you to come to work and spread your germs to your colleagues.

                They can give you notice any time they like. And having a manager really isn't good from an IR35 perspective.

                  Maybe you have one of those macho managers who would manage to turn up even if both his legs had just been blown off by a landmine. That type does not like sickies, even when they're not paying.

                  They can bin you for any reason, but should give the appropriate notice period. Let's face it, sickies happen to all of us at some time so your illness is probably a convenient excuse. Get your CV out.

                    WHS - with bells on. You are a company providing a service. If you are unable to provide that service they will simply go to another service provider.
