Opting Out vs IR35

I told the agent all along that I wasn't going to opt out, and signed the contract on that basis.

It's only today, 6 weeks in, that they have decided to change track.

Did you sign anything at the time saying you agree to opt out?

I checked with my boss and he said I should definitely opt out.......

I agree entirely, but my options now appear to be

• accept the new contract and face being placed within IR35.
• insist on keeping the original contract without signing the opt out, which is likely to just end in it being terminated.
• keep the original contract but sign the opt out, even though it is (probably) legally worthless, but will at least keep the agent happy.

Option 3 looks like causing the least aggravation all around ...

Option 4 - as you've already started then just tell them to Foxtrot Oscar. They can't make you sign a new contract. The best they can do is terminate your current contract (HINT: they ain't gonna do that).

Why? I'd say the OP has to shoulder some of the mess so why call the agency out based on half a story from someone we don't know?

Who is your boss? And how do they know?

My boss, as in my line manager - has been for donkeys years. I've checked with HR and my employment line reports directly into him - he said I should opt out of IR35.

So he's clearly an idiot so why are you still listening to him?

Just to be clear this is your boss at your old perm job isn't it? Not at your new contract?
