Which doesn't apply if you've opted out of the regulations correctly.

So it comes back to two questions:

    1) Is the opt out correct?

    2) What does the contract say about needing a timesheet?

Because if the first answer is "yes" then the second answer is crucial. If the first answer is "no" then the second answer is irrelevant.

If the client isn't to far away and you know when the person signing the timesheets turns up, then ambush them outside the entrance.

I provided a photo suggesting something similar, but, I don't think we are allowed any humour on the professional forums, any more.

Correct. It was in response to the OPs question which was..

You say: "What is your opt in/out status. If you have done it right they will have to pay you even without a signed time sheet."

It was a starter for 10 so hopefully he could go read up on it in great detail as this could be his best bet out of this. I couldn't be bothered to go find all the links to feed him it TBH.

            Job Done...

Turns out the CEO who had the power, doesn't.....and new CEO does. Job done.

New CEO wants to see me.....

Anyway, I'm off researching this opt in / opt out as that is clearly something I wasn't aware of and something I should be.

            Cheers all.

There is nearly always a happy ending with these situations when the right steps are taken TBH.

Regardless of your opt in/opt out status just make sure in future contracts you get clauses that link payments to timesheet and not being paid if the client doesn't pay them altered/removed.

As even if you have a signed timesheet a client can argue you haven't done the work and refuse to pay. This means you need other proof you have.

Not if you put the right wording on the timesheet they can't.
