    Permanent Candidates

    IT Talent are to provide you permanent recruitment services that is to say we will act as an agency as defined under the Employment Agencies Act 1973.

    You authorise ITT to seek work on your behalf within the field of IT.

    Contractors

    If you are a Contractor considering using the services of IT Talent as an Employment Business in the United Kingdom please read the following:

    Where we are acting as an Employment Business we will be providing subcontracting project work services and/or temporary assignments to:

    . Limited Companies trading legitimately outside of the provisions of IR35

    . Contractors who are represented by third party organisations (e.g. JSA or Giant)

    IT Talent does not supply workers who fall under the direction and control of our customers. Therefore, the Conduct of Employment Agencies and Employment Businesses Regulations ('the Regs') do not apply to the services that we supply.

    PLEASE NOTE:

    There is now an obligation on Employment Agencies and Employment Businesses to obtain a declaration from the Contractor AND their Limited Company as to whether or not they require the protection of the Regs in their dealings with the Employment Agency or Employment Business.

    It is therefore vital that you confirm by return of email that you wish ITT to act on your behalf, that you consent to your personal data being forwarded to clients, and that you wish to opt out of the Regs in order that you are not treated by the authorities as a worker under the control of the client for whom your company or any third party are providing contracted services.

    Please reply with "OPT OUT" in the header of your email with the following statement:


    Candidate Declaration

    I hereby confirm that the information given is true and correct. I consent to my personal data and CV being forwarded to clients.

    If, during the course of a temporary assignment, the Client wishes to employ me direct, I acknowledge that IT Talent will be entitled either to charge the client an introduction/transfer fee, or to agree an extension of the hiring period with the Client (after which I may be employed by the client without further charge being applicable to the Client).

    Both the Contractor (enter Limited Company name) and the work seeker (enter worker name), wish to opt out of the Conduct Regulations.

            I'm just waiting for an arsey/slimy representative to come on here either demanding the removal of this thread or attempting to justify the illegal business model and crappy e-mail.

            I'm not sure which would be more entertaining.
