    IR35 is on a contract by contract basis. You could have two running in parallel. One can be in the other can be out. Having them would have helped get you past the defunct BETs and go towards showing you are a business but won't affect the IR35 status of a contract.

    You eBay trade through your limited company?

          on previous gig, when i was discussing this matter with my accountant I had a lot of ebay activity and had that on my LTD , doing contract at the same time, and not being Vat registered then.

          Now today I have moved ebay activity on self-assesment (sole trading or whatever) and considering moving my money making websites to my LTD so that *maybe* they would have helped me with any IR35 investigations. Not sure what would be the VAT status of such income as i'm on flat rate, because of consultancy work.

            I'd suggest you go and try and get a full understanding of your situation and all it's nuances before posting any more on it then.

            And again, having multiple incomes can prove you are a business but will not affect the IR35 status of the contract you are in.

              I said im not an expert , but I thought it would start nice discussion when i repeated accountant words about having other business activity. Isn't IR35 all about disguised employees that have no intention to invest/ risk , just milk money out of contracts? If thats the case then having other business activity would help. You seem to be forgetting that

                Isn't it the 'contract by contract' thing that is key? Given that, HMRC will also forget your other activities, it's tulip really how HMRC behave

                  If you don't have enough work, go and do some other work. The client should be happy as they're not paying you for nothing, and you can get on with something more useful/enjoyable to yourself. This how I've ended up with multiple part-time contracts.

                  As an added bonus it annoys your agent.

                    Yes but you need to be investigated first (and chances for that are slim) , so having other business activity on accounts won't hurt you , and might reduce chances of being investigated maybe . Just speculating but more income won't hurt you
