Employer Intermediary Reporting - Anyone digging their heels in?

I've seen talk on other forums that the Employer Intermediary Reporting falls down in that, although the rules apply to Agencies and they can be fined for not supplying the details, the Agency can't pass this on to the Contractor so if you fail to fill in the questionnaire then nothing can be done.

Any general feeling on this? Or is everyone happy to pass a lot of information the Agency might not have over for a quiet life?

Simple refusal of doing something i don't want nor have to do. My contract is finishing in two weeks time. If this agency don't find me more work then why should I give them the information?

Some are quite happy to give away personal details to people who don't need them. Me? I'm not keen...

Can they? The agency might not want you on their books if you're disruptive perhaps, but it's the client I'm working for and they wouldn't have wanted me to walk anytime. OK I get it that if every agency needs you to fill this in then and you refuse every one then pretty soon you won't have any contracts unless you get direct work but I'm still not happy as a general principle giving out this information to people who don't need it.

The problem is you are trying to throw your weight around when you don't understand what's going on. Remember your contract is with the agency. You have no arrangement with the client so they don't matter. You are effectively pissing off the people that hold all the cards.

Just do it and move on.

You've covered this in your first post. They need it or they get fined. If they have a choice between peeing off you and peeing off HMRC, I hope you don't need more than one guess to figure out who they'll try and appease the most.

And what you going to do on the next contract? This is a 3 monthly reporting requirement. Dont submit the info if you dont want but dont come back on here moaning the agency have dumped you and HMRC have targetted you because you refused to play their game.

Of course they could just report the info they do have and politely inform the taxman that you refused to supply the missing data.

Keep an eye out for the brown envelope and make sure your house is in order.

Which bits of the missing info do you think it would take an interested tax man more then 2 mins to pull together?
