    No Notice Contract....Exit !

    Hi

    I want to exit my current engagement, half way through a 12 month contract. I have been on site for 4 years.

    My contract has a "no notice" section, in as much as there is no option in the contract for me to terminate early.

    The pimp is whingeing and I could do with a robust (though I'm not at the "Just FO" stage yet) response to exit.

    Thoughts ?

    Negotiate an exit with your client. He won't want you on site if you don't want to be there so with enough notice he can get someone else in and you can do a handover and everyone is happy.

    Remember the other option is you just bugger off and leave him in the lurch which benefits no one so he isn't going to hold you to your contract. Agent may moan a bit but he gets the option to replace you then he'll still get his money.

    Saying that you could get a sub in but that's a pain in the arse as you will have to find someone suitable and train them up in your own time to replace you. If you just want another body in leave it to the client/agent to sort it out.

      Negotiate an exit with the client, ideally get them to terminate the contract, that way the pimp has no grounds to winge at you.

      If you simply tell them to do one then they could come after you for loss of revenue due to your breech of contract.

      I'm assuming after 4 years on site that you have a good relationship with the client management there. If you can give them a reason you are going and agree hand over / replacement then there should be no issues.

      If you *really* want to go now becasue the client relationship has gone south then you just have to take a chance on it or get youself "fired" and have the client terminate the contract.

        12 month contract with no exit clause - wouldnt do it unless the rate was superb....

        3 months fair enougjh - if its crap just dont renew.

          That's because you are an idiot.

          So you would have turned down the 4 years of income the OP has managed to secure and will be able to leave mid contract without any hassle? Refer to my first sentence.

            Hmmmm...

            Just had a eal close read of the contract....

            In the contract the pimp can give me 28 days notice.

            In the contract there is nothing (at all) to indicate what notice I give them.

            I am assuming its a symmetrical situation, as per European Law.

            Anyway, I could simply pop the Ltd company.

            Anyone ?

                BTW 'Popping the company' won't work either as there is a thing called 'Lifting the corporate veil which identifies you as a person'.

                  OK let me reword. I would be very careful about signing up for 12 months with no exit clause.

                  Yes its worked out for the OP. BUT, and we're always banging on on this forum about meeting obligations. So you sign up for 12 months - get on site and its tulipe, work is not what they told you, client is a tosser but its too late.

                    Which is when you raise those issues with the client and agent. Deal with them in a professional, business like manner. Not like some snivelling little oik threatening to take their ball home.
