The bottom line is you are a business delivering to a client for payment. They haven't paid you now have a commercial debt so have to recover the monies owed with this in mind. Dunning them, letters explaining you will be adding a percentage to the outstanding debt and finally a solicitors letter nearly always sorts it well before court action.

Once a supplier's relationship has broken down to the level then you need to move on. There will be no permanent or contractor gigs here now. You have more than likely burnt your bridges and you need to move on.

This new structure was deeply dysfunctional - and created situations like mine. Ultimately I guess was the Head's creation - and they are responsible.

And is the work that is detailed in your contract schedule? The lead having you working across many projects sounds very much like control to me.

What rubbish. Besides being highly unprofessional what would that achieve? Someone spots it and mentions it to the client who can identify the contractor....

You seem to be hung up on this internal system like it is the godly bearer of monies. It also now sounds like this is just the default state for time entry with no codes. You originally said the client was actively rejecting and marking you as absent. Is this now not the case?

Also is this the approved timesheet mechanism that your agency also has access to, or produces agency timesheets from?

From the agents perspective (who they have a contract with), all that should matter is that the he/she can invoice the client in accordance with some acknowledgement from client that you turned up and did some work. Using 'official' letter headed paper timesheets or "it must be inputted on system X", is all nonsense.

Whilst this is the only information you seem to have to go on, we still don't know the real reason they haven't given you this allocation for 4 months. If the agent has provided a contractor and there isn't really any funding at clientco in place for the contractor, the agent should be warned so that they can pick up the phone and interrogate whoever signed the agency/clientco contract. Whilst it is very odd your agent doesn't seem to be bothered that you haven't got your timesheets signed for so long, they will be bothered if they smell a liar without any real budget at the clientco.

No agency would be happy to have a contractor on site and not be paid for them.

In fact some agencies clearly put in their contracts to stop contractors delaying submitting timesheets if you don't put in an invoice within 2 months you aren't going to get the money simply because they can't get the money if you don't have timesheets.

IR35 would seem the least of his/her worries right now.
