This is definitely a case of "...white man speak with forked tongue....". I think what he means is, without actually saying it, is the following "...The S58 legislation has no effect on the taxpayer because we (HMRC) always thought that the scheme didn't work, and this legislation just makes it a bit more clear. Got it!..." With that sort of logic it's a wonder why we need all of these expensive tax courts, why not just scrap them, and let HMRC decide; adjusting the relevant legislation retrospectively, whenever necessary, when they need to 'make it a bit clearer what was meant in the first place'.
The Tory MP is conveniently mixing up fact, i.e. the legislation does have a material effect on taxpayers, with opinion, i.e. what HMRC would like us to believe.
