Enquiries/Investigations

I can't work out whether people impacted by BN66 are under investigation or not. I appreciate that HM Revenue & Customs have written to scheme users saying that they have opened enquiries, but is this the same as being investigated? Does anybody know the difference?

from my understanding, we were under investigation in terms of justifying income etc for relevant tax years. Then HMRC closed the investigation and sent out closure nortices which are currently under appeal pending the tax tribunals.

Thanks SD. Quick follow-up question, what about EBT users? Are these users currently under investigation? Again, enquiries are open but no word of an investigation?
