Actually, although the letters come from Brannigan, he is not in charge. It's a guy called MacDougall above him. MacDougall was the one who gave evidence to the High Court.

...and there is no better example than this to demonstrate how the country is run not by politicians, but by unelected civil servants under their own totalitarian agenda. Utterly depressing if you think about it for too long.

In order to take a complaint to the Ombudsman you have to first exhaust the public authority's complaints procedure. We had to start by complaining to HMRC.

No, MacDougall was only in charge of the investigation. He, along with Brannigan, are in Special Investigations.
The person responsible for BN66 was much higher up the chain:
Simon Davis
Assistant Director
Business International
Litigation Team
HMRC didn't come up with the idea themselves. We understand that it was a Tax QC who suggested it to them as the only way to dig themselves out of the hole they were in.
HMRC deny this but we are sure they were advised that litigation would almost certainly fail.
