    ...and there is no better example than this to demonstrate how the country is run not by politicians, but by unelected civil servants under their own totalitarian agenda. Utterly depressing if you think about it for too long.

      Forgive my ignorance but why did we complain to HMRC about HMRC and then express surprise about HMRC's reply? Or have I got this totally wrong? Or has MacDougall got many diff positions in this sorry mess?

        In order to take a complaint to the Ombudsman you have to first exhaust the public authority's complaints procedure. We had to start by complaining to HMRC.

        MacDougall only has one position in this sorry mess and that's why it's a joke that he should respond to the complaint which is about him and his staff.

                Not really because the complaint refers to an individual taxpayer and their personal circumstances.

                The taxpayer is being supported by NTRT with their complaint against HMRC but it is not NTRT actually making the complaint.

                Does that make sense?

                    So is MacDougall the one responsible for rewriting history and was he the one behind the meeting in Oct 2007 when they first came up with the BN66 idea ?

                      No, MacDougall was only in charge of the investigation. He, along with Brannigan, are in Special Investigations.

                      The person responsible for BN66 was much higher up the chain:

                      Simon Davis
                      Assistant Director
                      Business International
                      Litigation Team

                      HMRC didn't come up with the idea themselves. We understand that it was a Tax QC who suggested it to them as the only way to dig themselves out of the hole they were in.

                      HMRC deny this but we are sure they were advised that litigation would almost certainly fail.
