...will the GAAR then be used retrospectively

....but I guess, if they chose, they could just say that any scheme at any-time that falls foul of the GAAR is impacted by APNs and FNs.

I heard of one person who didn't declare any income from the scheme on their tax returns whatsoever.

      And guess what?
Like I said a few times before, there is a lesson in this whole fiasco: everything you say can and WILL be used against you.
So when in doubt...say very little!
(And should we not ALWAYS doubt HMRC & associates?)

He now gets free accommodation, 3 square meals a day and is learning to be a cabinet maker?

Evasion might be harder to detect, but you really don't want to get caught!

My son actually likes the fact I won't be working as he'll see more of me. I told him we'd be ok as we'll get a council house and benefits. And he gets a fabulous holiday and loads of treats until the bailiffs arrive, by which time we won't have anything except the clothes we stand up in.

you have to do something pretty bad to get locked up, If I knew then what I know now I would not have declared the income on my SA either. Decision being, get shafted years later by HMRC with probably a 100% penalty on tax evaded, or get away with it ALL!!!! To some people who cant pay, it wouldnt make a blind bit of difference if they had a 100% penalty for evasion, they cant pay anyway. But boy what an upside if you get away with it! Good luck to them IMHO.

What Gauke et al Im sure are very much aware of is that they will absolutely push a percentage of the population to take tax avoidance underground and dont declare DOTAS numbers or even the income on their SA's, which in real terms then becomes evasion.

I suspect there will be a few more people leaving the country.

If my circumstances were different I'd have gone long ago.

Surely if you knew then what you knew now, the obvious choice would be not to have signed up to the scheme in the first place!

thats the ultimate yes of course, I was in it for about 6 years from 2001 - 2006. So plenty of years past signing up to accidentally miss some of the SA amount boxes! Unfortunately, or fortunately whichever side of the fence you sit on, I didnt complete my SA's. This was done for me so all declared and above board.
