With that sort of logic it's a wonder why we need all of these expensive tax courts, why not just scrap them, and let HMRC decide; adjusting the relevant legislation retrospectively, whenever necessary, when they need to 'make it a bit clearer what was meant in the first place'.

    The Tory MP is conveniently mixing up fact, i.e. the legislation does have a material effect on taxpayers, with opinion, i.e. what HMRC would like us to believe.

      ...which brings us back to Reckless' point

      Any legislation that needs to be clarified was therefore by implication poorly written and misleading in the first place.......

        Oddly enough, that's very close to what they actually said as part justification for s58 - Litigation would have been too costly.

        If this ever makes it to the ECHR, you'd hope that an eloquent QC would have some resounding words to say about that.

                Montpelier & update

                Been out of touch for a while on this - although followed the lobbying campaign and wrote to mp etc
                What's the status with Montpelier?
                Is this actually being taken to tax court/ tribunal now ? I get the usual threatening letters from HMRC but when am I going to be asked to actually pay?

                  Yes, appeals are being taken to tribunal.

                  However there's a big backlog at the tax courts, so it could be a while before the cases are heard.
