    Since then I have requested a face to face with my MP, so I can explain that during my time in the Tax Planning scheme I did pay tax and NI on the non trust amounts and that HMRC, even tho it was "under enquiry" I received requests for payment of PAYE and penalties for late payment, which I read as HMRC accepting that the scheme was legal as the requests referred to amounts outside the scheme. By the way from the time I joined the Tax Plan I paid HMRC the self employed NI contribution via Direct Debit to ensure that my state pension would not be jeopardised.

      Spent 90 mins there this week. Very interested in the Vodafone issue + the fact that CoA confirmed this was pure retrospection (and hence contrary to HMRC's convincing argument to JK that it was simply clarification). This of course is a matter of plain fact. Its not an allegation of any sort. The CoA judgement is what it is.

      She urged everyone to contact their MP's and go and see them and explain matters. [20 minutes is not enough - book in longer.]

      She was generally supportive and recognises that something isnt "right" here. Agreed to raise it with various people including own colleagues. A very savvy and intelligent MP. Highly professional; I was very content.

      But, Ganimos, she wants to hear asap from her other constituents.

        Vodafone India retro

        UK did an India in 2008 to levy retro tax - The Times of India

        This isnt looking too good for Mr Osborne. Gideon - either stop supporting Vodafone (and then carry on sending us letters via HMRC saying "you were warned, nothing we can do, sorry, now p**s off) or carry on supporting them and support us as well. You are currently "two timing."

        Suddenly BN66 is getting international attention. Perfect timing for us, it really is.

        I urge everyone to raise this particular matter with their MP's asap. This is extremely serious.

        Even the FT is commenting on it.....

            Absolutely priceless.

            I was wondering whether a lobbying campaign in the UK was a waste of time. Perhaps our efforts should focus on inward investors and warn them of the uncertainty that the increasing use of retrospection may place them with regards to taxation in the UK.

            However, it looks like we dont need to bother as Gideon Osborne is doing an absolutely brilliant job for us - for free.

            I think that we are seeing the law of unintended consequences coming into play. I can't believe it will end here.

                There's an opportunity here for the Government. If Osborne comes back and asks the right questions, there is time to repeal it now, under the guise of 'while we do not condone ... blah blah ... this is dubious legislation ... blah blah ... enacted by the previous Government and opposed by us ... blah blah ...'. If they don't do it now they have to live with the consequences and backtracking will be more difficult. Whoever thought it was going to be India that was going to bring it all to a head. Funnier still, Osborne over there protesting makes him like Vodafone's WG.

                Some of the heavyweight business magazines will hopefully start to pick up on this and we'll get some more feel for how this is going to play out.

                Is the tide starting to turn? It definitely feels like we're not on the back foot anymore. A great way to enter the Easter break.

                    I do believe that commenting on these articles, especially the ones that don't sight section 58, is a great way to raise awareness to our plight.

                    I just wonder if Mr Osborne was even aware what significance s.58 had when he distributed his recent generic "no repeal" note to mps to forward to us. Hopefully he will start to look into it now!

                      Lets face it the chancllor seems determined to do nothing and has already drawn a distinction between us and Vodafane.. i.e. Vodafone won in the courts...we lost in the courts, (completely ignoring the fact that that wasnt the right court,and that we have consistently been denied our real day in court). Thats all we want isnt it, to have our returns tested in tax courts according to the law as it stood. I just dont want to get too excited and have my hopes dashed... again
