I searched my spam folder, but not received that spam. just found a few other "can personally guarantee will meet the deadlines" emails from Upton... Which weren't met...!

Are there any industry watch lists for accountants? I guess the court case may be enough. Googling the name and FSA site comes first.

Unfortunately in the UK it's not a protected profession.

True which is why you should only (IMHO) use a Chartered Accountant

In the UK, there are no licence requirements for individuals to describe themselves or to practice as accountants, but to use the description "Chartered Accountant" they must be members
of one of the following organisations:

• The Institute of Chartered Accountants in England & Wales (ICAEW) (designatory letters ACA or FCA);
• The Institute of Chartered Accountants of Scotland (ICAS) (designatory letters CA); or
• Chartered Accountants Ireland (CAI, which is an Irish rather than a UK body but covers Northern Ireland as well as the Republic of Ireland), designatory letters ACA or FCA)

Not sure if this is the right thread to try to convince anyone of that helping though, since Darren was a member of the Association of Chartered Certified Accountants until he got thrown out in September.

And while it's good to see that ACCA is taking action if anyone is breaking their regulations, it also shows that it might not be much help, since looking at the allegations in that pdf, it took about 2.5 years (FSA shut down the scheme in March 2009 I think and allegation 2 also mentions March 2009) from him breaking the rules until they took action...

Pursuant to bye-law 8(a)(i), Mr Upton is guilty of misconduct by reason of
holding the position of director in a firm, namely Freedom Accountants Limited,
which holds itself out as being available to undertake public practice work in
the course of the firm’s business without holding a practising certificate from 28
March 2011, contrary to The Association of Chartered Certified Accountants’
Global Practising Regulation 3(2)(a) (as applicable 2011).
