If the west end and second canary wharf were fictitious and the only actual contracts were city and canary wharf then yes you would be caught with another 12 monther in the city as the two contracts would total 24 months with 14 months in between which would mean over 60% of the time at one location

No because it means he is well under the 40% at any location.

Ok so forgetting the other 2 fictitious - if I did :

        canary - 14 months
        City - 12 months

Still caught as they are both in zone 1?

Hope I'm not giving hector any ideas..

Possibly. Unfortunately that would be down to HMR&C to decide and you to fight if it came to it - what's your travelling time to each site from home?

The best way to avoid the 2 year or 40% rule is to become an MP.

About 10-15 minutes in it, from Waterloo the Jubilee to Canary Wharf can be about 20 mins (6 stops), from Waterloo to Bank on the drain is 1 stop so about 5-10 mins..

West end is a different story

Thinking about it this whole thing is absolute effing bulls$it

We live and work where we live and work - now we have to turn down contracts next door to each other for completely different clientcos so as not to fall into one of their stupid traps..

Has anyone taken this to a tribunal?

You could then reasonably argue that your travelling time has doubled but the ruling comes down completely to the interpretation of 'substantial' so whether the difference between a 10 and 20 minute journey would be enough to satisfy HMR&C I wouldn't like to say TBH
