Hi - anyone else having trouble getting payments from Qualitas People Solutions? The moved me to a monthly payment date from weekly last year and have been unable to meet their own settlement dates ever since
I have been having problems with them for several months. Often not getting paid for two months in a row. They usually blame my clientco for delaying payment to them or me for submitting timesheets "too late", for example on the 4th of the month.
Hi Emmy - Sorry to hear you seem to be in the same position as me - They absolutely shouldn't be witholding payment due to the client not paying them. Qualitas is bound by Statutory Instrument 2003 No. 3319 - The Conduct of Employment Agencies and Employment Businesses Regulations 2003.
Of particular note for you is;
PART II - GENERAL OBLIGATIONS
Prohibition on employment businesses withholding payment to work-seekers on certain grounds
12. An employment business shall not, in respect of a work-seeker whom it supplies to a hirer, withhold or threaten to withhold from the work-seeker (whether by means of the inclusion of a term in a contract with the work-seeker or otherwise) the whole or any part of any payment in respect of any work done by the work-seeker on any of the following grounds
(a) non-receipt of payment from the hirer in respect of the supply of any service provided by the employment business to the hirer;
I've quoted several sections of the EAA Regs direct to the CEO, Colin Gerstein, with the threat of legal action unless they cough up immediately - I'll repost here if I get anywhere . . . not gonna hold my breath though
In arrears with the last invoice settled being week ending 28 November - I've involved the client to make them aware that I may have to withdraw my services - they have been incredibly understanding and have contacted Qualitas to highlight that they are in breach of the contract in place between them by not paying me - due to the breach they may be able to sever their association with Qualitas and ask another agency to engage my services - bit of light on the horizon but it still doesn't get me my money....

I'd strongly recommend you notify the client you won't be in on monday unless the issue is resolved, explaining that you haven't had any payment for work done for however long it is since you last received payment.
It looks like they've hit financial trouble and for all you know (and whatever they may say) they may no longer be able to pay at all. I would only take actual payment into your account as confirmation they can pay and not any potential bs they give.
Each day you continue to work whilst in this situation is another day you are potentially working for nothing. By withdrawing your services asap you not only reduce the potential bad debt but also put the onus on the client to pressure the agency into either paying up or letting the contract go.
If the agency cannot provide you to the client (because you are withdrawing your services), that may be enough to allow the client to claim the agency has broken their contract, which will allow any exclusion clauses about going direct or via another agency to be ignored.
