Lawyers cannot represent against a party with who they have had any dealings with in the past... I dunno if there is any law/ethics like this for judges.. Obviously NOT!

HMRC's delay was incompetent

When you think about it, HMRC's long delay in closing the scheme was seriously incompetent.

Even if they are successful, they won't recover all the money that was sheltered by the scheme because so many people have spent it (because they believed that the scheme worked) and simply can't pay.

If they'd closed the scheme as soon as they became aware of it (hopefully prospectively), they would got higher taxes from people going forward - as well as avoiding a lot of worry for honest people.

In any event it is necessary for Huitson himself to want to appeal. (i.e. just because this decision is important to "you" collectively doesn't mean the appeal - assuming so advised by counsel - will happen).

can somebody confirm if MTM are in the process of writing to all members to formaly confirm what happens next ?

Apologies but I haven't read all of the posts in the last few days but is it likely that there will be HMRC demands arriving within a few weeks/couple of months ?

Has anyone ever thought that the reason we are being singled out for retrospection, amongst all the other schemes that have been shut down prospetivly only, is they they have picked us out of the hat as the one to make the example of?

So they may never use restrospective again, but will have us to point to, to say look we 'could' do it again.

I would go so far as to say that govt's should be in power for 1 year only. That way, they will never be in long enough to do any damage
