    I've found that agencies "accredit" a certain list of Umbrellas (the usual suspects Giant, Orange Genie etc.) and the choice given was use them or go Ltd. The distinction wasn't to do with self-employment or employment more the identity and perceived type of the "management copmany".

    Having said that I certainly wasn't aware of MP employed arm and would be interested to learn more as this option wasn't suggested to me when I told MP why I could no longer use the scheme.

        They can come and have a go if they think they're hard enough. I operate a small business wholly outside IR35, my contracts are all professionally reviewed and this has been confirmed, I ensure my working practises show me to be in business on my own account, have a website which I advertise, etc..etc.. and if they want to waste their time I've got insurance that pays legal costs, tax, interest and penalties in the unlikely event HMRC prove otherwise.                       It might be worth you getting in touch with her directly and pointing out the extensive parallels between this case and yours. It could strengthen both arguments.
