      What, and miss out on the real fun? Remember we are dealing with sadistic bastards here.

      I had to laugh at one of the replies I got back from Stephen Timms, which suggested I contact Mr B if I was facing difficulties. Yes right, and this would be the same sod who has been sending me threatening letters for the past 5 years.

        On this theme - in case it helps, my MP is Lynne Featherstone (LibDem) I would bet that there are others living in my constituency being a prime area for City workers. Thought I'd mention it in case others have written to her, no reply as yet. She can be quite proactive but I'm not sure whether this is the type of cause she would take on - she likes traffic issues, recycling, generally attacking Haringey (useless) council, hospitals, schools, police - you get the picture. She is a decent sort though so I'll reserve judgment, if she gets enough letters she might get interested.

          Of course Montp are ready for them to go down the collection route and have their defences ready. I suspect HMRC know it which is why they have not gone ahead. Seems to me like a game of chess.

            Labour MPs

            It is unlikely any Labour MP will take up our cause. The best we can hope for is that they ask a Minister to respond. But be warned, they are trying various tactics to even avoid doing this. Be prepared to be fobbed off.

            But don't let them off the hook! If you are not sure how to resond to their evasion tactics, email me.

            As an example, one guy got this from his Labour MP:

            It does, however, appear from the account that you have given me that you and others in the scheme were using it as a device to move your earnings offshore and must have been aware since 2004 that HMRC believed your action to be illegal.
            Don't get drawn in to pointless arguments with MPs who have got their own agenda.

              Just got a letter back from The Rt. Hon. Frank Dobson, M.P.

              To allow me to pursue all the points you raise, it would be greatly appreciated if you could let me have your National Insurance Number.
              Might be worth including this in the template to save having to send further correspondence....

                  So why are they backdating the changes to 1987 then, I left the scheme in 2003, the bill will still break me.. what would this labour MP's response be to me?

                    This MP needs to answer the question how we would be aware.

                    It is up HMRC to writre to us each directly or for our advisers to notify us. Surely he does not expect us all to be following the arcane statements issued by the Treasury.

                    ASAIK there was no major media coverage of this so how was the "Man on the Clapham omnibus" expected to know what HMRC thought was unacceptable.

                    His use of the word illegal is unfortunate and of course incorrect.

                    If we declared it on our SA forms it was not illegal or fraudulent, just a matter of us excercising our view on our and MontP leading counsel et al interpretation of the tax rules.

                      Steven Timms Letter in the Guardian

                      He very kindly makes the distinction between avoidance and evasion, one is legal, the other not. We seem to fit into a different class though, legal avoidance, made illegal after the event. Perhaps we need a new term 'avasion', 'evoidance'.

                      He states the government will be relentless in pursuing avoidance, (particularly I assume where it gives companies in which he has an interest a competitive advantage. (Ovum/IR35 ))
