    Closure Notices Update

    Only 80 received by MP as of yesterday. Significant number contain mistakes.

    It must be well over a month since Special Investigations instructed local tax offices to issue CNs.

    IMO, HMRC seem to be making a complete hash of it.

        SA statements

        Has anyone also received revised statements of self assessment following the closure notices. I have now received both, ironically the SA statement thanked me for my revised accounts.

        However, I have received SA for only two of the three years involved, one of the years I didnt owe anything, the other doesnt contain any interest, and I've received nothing for the year that was 'discovered'.

        This would effectively half my tax bill.

        Is this my tax office using discretion and reason, or just a cock-up?

          "discretion" and "reason" and not part of the HMRC vocabulary!!

          Hence draw your own conclusion!

            I have yet to receive a notice for each year. There is some dialog between HMRC and MP over the amounts to use! I don't see any point in rushing them. When does your 30 days run from if they then change the "closure notice"? Is is a closure notive, or just an amendment to your tax return?

                None of them are valid while the JR is going on. I reckon they have 2 years to check them!

                They have been going through the ones they got - quite a few wrong numbers. One would not expect that from HMRC.

                  if thats the case, then isn't there an argument here for accepting the bill that HMRC have sent you?...if thats the tax demand they have issued you then it might be worth considering paying that off...then you could sleep soundly at night safe in the knowledge that all your troubles have been resolved...

                  as opposed to waiting for the whole JR thing and ECHR to draw out over the next few years and potentially losing everything...

                  this is, of course, assuming that HMRC cant come back at a later date and claim they got THEIR calcs wrong and present you with another bill...I really cant see how they could ever get away with that...

                  I'm not suggesting that you should do this - just playing devils advocate - but it might be well worth considering...in your shoes, I'd find it a very difficult decision to take...but it does have its merits...

                    I thought the rule was - if we make a mistake we are criminals feigning innocence. If HMRC make a mistake its a mistake and we have to pay up.

                      Received CNs for 4 years, clearly wrong. They didn't even manage to accurately account for tax payments actually made on account for the self-employed income etc.

                      Have received one SA for the first year. It doesn't tie back to the CN for that year! Again, forwarded to MP.
