    Closure Notices

    I got my closure notices sent through on the 23rd of Sept.

    How is everyone feeling about the judicial review? When is it?

    Not planning on settling just yet...

      Brillo without knowing you or helen7, can I just point out that its pretty ignorant and very convenient to dismiss someone as not being in the scheme as they point out something that you dont like. Have a re-read and think which part exacted your reply.

      And as for helping people by PMing them - well thats all very well, but then why even bother with the banter. Just post blank responses. And personally I have had pretty useless info from this board as its all uniformed optimism without reality checks and people wanting to PM me to find out a new revelation without sharing any info.

      Basically against the very spirit of a 'discussion' board.

      Oh and along the same logic as you - do YOU work for HMRC?

      Good luck to everyone, but reel your egos in.

      Oh and before you come back with your usual "do you work for HMRC"/troll doomer/Mal comeback, if you recall we have already had that nonsense a few weeks back..............

        Chill out dude, Brillo has a thing for Helen7, always has ... she is a bit of a doommonger though.

        As for uninformed optimism, what else do we have? judging from the poll 25% of the people here will be ruined if it goes against us. Its all we have to cling on to... my marriage is running aground as we speak primarily because of this..

        as for the settlers I just thought of a reason to settle now... lottery win

          Another reason for uniform optimism is the fact that the revenue read this....

          As for winning the lottery.. if i won i'd actually fight harder .. the money wouldnt be as impt but the principal certainly is....

            Yep - you got me - I work for HMRC.

            No point in sensible discussion on an open forum that anyone can read. Something I pointed out a while ago.

            Whenever I see rubbish I am going to point it out - post what you like.

              Correct, but it became law with retrospective effect. The appeals process argument is that we could not have submitted returns before 12/3/08 because we had not been told the law had changed...now that it has, I just don't see how we can claim exemption.

              It was a perfectly reasonable question. My 07/08 return needs to be correct. If MP want to claim an illegal exemption on my behalf, for which I have full responsibility I want to know other peoples thoughts on this.

              I was in the scheme for 6 years and have a potential liability of well over 1/4 million pound so find it hard to be optimistic when our only defense is 'ooo my human rights have been breached'.

              What can the judicial review actually achieve? - I understand from wikipedia that in the UK they cannot reverse the law.

              'Although the Courts can review primary legislation to determine its compatibility with the Human Rights Act 1998, they have no power to quash or suspend the operation of an enactment which is found to be incompatible with the European Convention of Human Rights - they can merely declare that they have found the enactment to be incompatible.'

                Is it NOT Law? The Royal Assent made it law. Doesnt matter whether you or I like it. Yes MP and others will hopefully be successful in a judicial review, but Helen7 pointing out that it is lawmaybe rubbish to you, but is actually quite a valid statement.

                  I have read the 2 posts above - personally I am going to rely on montpelier - but you can do what you like.

                  WE have not even had the JR submitted yet.

                  Just try to remember who is reading this stuff - it is a public forum. Even on certain closed forums it is rumoured that they have been read by HMRC.

                  I have been of the opinion for a while that there is a very good reason that montpelier tell us very little. The 2 posts above illustrate this perfectly. trolls are hardly needed on this forum - there are enough enemies within. Apologies to the 90% who are good eggs and that it is spoilt by a significant minority.

                  I would setup a closed forum - but not enough time. If someone wants to run one then shout - we can discuss on PM. I have served my sentence being a moderator - I wont do it again. I would like to say (as I have said on many occasions ) how much I admire the mods/admin here having been in their shoes. And apologies for all that aggro I caused last month.

                  Right - I am off to tpd where I will find some (relatively) common sense.

                    Firstly referring to a couple of earlier postings I think that there are far more of us than the 25% with no savings facing total ruin. I'm in the offset mortgage camp but it won't nearly be enough.

                    When faced with the stark choice of ruin or optimism it isn't suprising that many of us plump for optimism - if the worst is going to happen there is little I can do about it so I reckon its best not to get too stressed worrying about it (pretty hard though)

                    With regard to your query about the JR, I'm guessing (no actual knowledge for anyone interested) that the JR is designed to confirm incompatibility with the Human rights Act which will then give leave for an appeal to made to the EU Courts which may be able to quash the retrosepctive part of the legislation. This is where it could get messy and time consuming (not necessarily a bad thing) but I think the JR needs to go our way first.

                    As for the 07/08 return if we fill it in without claiming the relief that years tax (plus interest) becomes payable now and can't be appealed against regardless of JR or EU. In light of this I'm happy to still claim the relief even though as you rightly state it as against the law as it stands. If we lose and penalties are applied so be it because as I've said before "I can't be more ruined"

                      Welcome to the bn66 thread and well done for not lurking.

                      No date for JR yet - not even applied for. It will be applied for in coming few weeks - will probably be heard in the new year.

                      Will you join us at the RCJ on the strand?
