I have been given some advice...

My accountant says that it would be a good idea to keep up awareness of this issue... well can't do any harm...

    QUOTE
"I would strongly urge you to take the time to write to your local MP. You can point out the unfairness of this Retrospective law and how it is in breach of the Human Rights Act. Perhaps you can also outline how it will affect you personally.

Ask them to consider raising the issue in Parliament and with the Revenue."

I have sent an email to my MP and will report back with the response...

          From the post by Mal

I think I could make a good guess...

          "Dear Mr BrilloPad's MP

Thank you for your letter from your consituent Mr BrilloPad. It is the nature of government to apply laws fairly under all circumstances. This law has been unfairly applied so some have been able to benefit. This isn't fair, so we're changing things so they can't, and fining them for having done so. Tell him he's stuffed, we don't care, we're the Governement and we do what we like.

          Regards
          H M Treasury Junior Minister"

Well that's what it will mean, anyway. The wording may be a little different.
Well Mal was wrong on that - I heard nothing back! And even if I got anything back I doubt it would make any difference. There are better ways forward.

              HMRC versus the real world

I have not been able to find a forum dealing with the property in general or developers in particular but there is a large number of big players in this sector.

Sums of money are huge often going into the millions of pounds per deal so its clearly going to be a massive problem to a lot of people when HMRC eventually track them all down.

The legislation is not yet full through parliament, but will get through with the usual gov majority and our only hope now is Judicial Review which I understand it being pursued.

I would have hoped that the big players like Montpelier PWC KPMG etc would join forces to make a single JR on this retrospection matter. The more behind the JR the better teh case will be.

In the usual British Estblishment tradition HMRC will try to pick off individuals rather than face upto a court case.

As far as I am aware HMRC has shied away from taking any of these cases to the Special Commissioners and have relied on the gov majroity to get a legal "clarification" of their interpretation.

Have been under enquiry for about 4 months and now the matter has moved on with revised assessments. We will appeal the assessments.

Did anythink become of the proposal to have a meeting, united we stand but divided we fall

Odd. AN MP has a statuory duty to reply to all correspondence. I should chase him up (and copy his consituency office) and ask why he has failed to respond to a serious (and to you, highly important) issue. They're on holiday from the HoC, but they're still MPs.

No it won't make any difference - unless someone asks what you have done to facilitate a resolution...

                    Pwc / Kpmg / Montpelier

Hi - just wondering if anybody knows who is dealing with with this matter at the three companies mentioned here? I have been told by Montpellier...

...not sure though if they have "joined forces" or otherwise. Would 3 separate JRs be permitted / better? Anybody know what is likely to happen now?

Not sure where you heard this but the Finance Bill became law in July. Most of us got a letter from HMRC saying the closure notices would be on there way soon.
