When do they start to investigate you for IR35?

Do they investigate the following tax year after you start the contract?

They can get you anytime. First you'll know, armed police will be dragging you out of your bed at 3.00am at gunpoint. This is quickly followed by deportation to a secret holding camp on the Isle of Wight, known as Camp Photon.

    You have been warned.

Ive contracted for 8 years never been auditted.

In my opinion you may as well say you are always outside IR35 regardless and wait for a pull. Some are, some aren't.

If I'm wrong, then let them go through every contract for every part of the years they want and ask me for the cash and fine me.

Otherwise, I just aint paying it.

Whilst a slight exaggeration, the 1st part of Denny's post is true.

The message is - do not see these people on your own. Make non-commital "hmm"ing noises when the IR lady says "it's informal - you don't need to get your accountant involved in this piffling little meeting". Do not believe her...

Arrange to see them at your accountant's premises with said accountant present...

If you have any PCG-like insurance, contact your insurer's the moment you get the letter/put down the phone. As with any insurance do not admit to anything...

A contractor I know went to the Inland Revenue office to ask them about IR35, and they said it "only applies to builders".

                So there you go.

Denny, yes you have that bang on. Inspectors are EVER such nice sorts, not bothered about minor infringements, etc. Some fall for it like my neighbour and say something stupid when they think the interview is over and it seems like polite chat.

If you get an IR visit, make sure you know the rules, supply only what they entitled to see, be polite, volunteer nothing and remember they are demons from seventh hell in human form out to ensnare your soul.

PS The Fair35 insurance is good I reckon although It only covers cost of investigations and penalties not unpaid tax.
