could it not benefit me in this instance as i can just walk away and work for another agent (with the same client, if i want) ? what are your thoughts? -
You could change agent, possibly, but currently with no signed contract, then the agent has no legal obligation to pay you a penny for the time you have worked.

Ignoring how much the agent is making on this, you agreed for 395, so clearly you are happy on that rate. If you thought that rate was low, why did you accept it? You should have rejected it and found another gig.
These things happen, just finish the contract, work the 4 months, get a new gig and use this as lesson learnt. Set a minimum rate for yourself and don't accept anything lower.Vote Corbyn ! Save this country !Comment

And the client has accepted you so they have a contract with the agency on that basis, so the client won't be able to hire you through another agency. You're screwed to some extent whichever way you look, so take the hit or take a walk.
