Providing they have the right number and skill set of perms.

The consultancies fall under the rules, so won't be able to use contractors to fill the gaps.

      Is that a definite now?

What if HPE was my client and DWP and Aviva were the accounts I was working on?

Depends where you are sat. Sat in a DWP office is a definite hit (you are a bum on a seat there) otherwise it will be a question of how risk adverse your agency is....

That's how I see it also.

Looking at agencies past behaviour, as a general rule, I think we know how most of them will choose to deal with it.

Might be OK then. HPE tend to contract people to their nearest HPE office. Might mean some 'creativity' in your travel expense claims.

NOTE: I'm not at HPE but was looking at a possible role. Would be a grey area as the role is across multiple accounts.

Are you going to have separate statements of work for each?

As Eek said, I would be asking how the agency was planning to handle the role, also.
              Inside or outside?

ehh, so youre telling me Cap couldn't hire a contractor and place them on site at a PS client?

Of course not. But that contractor would be deemed to be caught by IR35 and so CAP would have to pay them as a permie.

Your problem with that is the one month delay before the decision has to be made.

                    Don't worry you're outside
                    1 month later
Oops Computer says no - you're inside.

Then the contractor discovers that the payment method is not a material term of their contract and they can't leave.

Have you actually read the proposals, they are very clear?

Cap can hire who they want, whether that person will agree to be inside is another question?
