No To Retro Tax - Ongoing battle against S58 FA2008
I think you may find it is pay within 28 days of the due date or you get a penatly and the due date will be in 90 days ...... or does it have written on it a due date of 28 days time ? didnt think they could do that
Your right - Pay in full within date shown (end of July), then 28 days later get a surcharge of 5%.
Time yet to win the lottery ;-)

I have received notification from MP that my APNs are not valid, together with their reasons and the outline of a letter I must send to HMRC to point this out, asking for them to be withdrawn. The reasons are not specific to my case so I cannot see why they will not apply to yours as well. But send them off to MP and await their instructions.

Great thanks a lot. Makes me feel a little better already.

DR/Santa> I know its ball ache getting a closed forum and validating the users but surely we can get you help and validation for the members ? ...I personally know and can vouch for ~30 members and good mates with Brillopad who will have another list.
As mentioned ...........its the pointy end and families will be making decisions based on the information we have on these pages and the questions asked ..and can we get everything dealt with exposed as we are ?
Also there is a potential split in members:-
a) those who went on to have Ltd companies .................................................. .......wary of a full HMRC probe
b) those who went permie or left the country or facing bankruptcy ........................ keen to pull the pin.
On a closed forum both groups can be handled in different threads rather than the 1 exposed giant thread we have today.
I remain at your service

This is the point. It's horses for courses and the knock-on effects post 2009. I split the following year so the retro fraud angle is the main concern for me. Whether the review before FTT will help to dilute that is a Q for the QC. Could HM pursue the fraud angle irrespective of the FTT result - Q2 for QC. It's throwing up images of Jack Nick and Tomo in A Few Good Men. We all know how that went.

May I ask for what years you were in the scheme?
I've heard of some years not being valid for one particular reason (not discussing on here)

I think HMRC can perform 'discovery' on tax years where they have previously issued a closure notice but only where there wasn't full disclosure at the time.
They have a difficulty here because as far as I am aware no new information has come to light....
Given that they have also been to court on numerous times (JR, FTTT) I think that claiming fraud now would sound ridiculous.
