        Settlement negotiations

        We simply cannot trust HMRC

        Even if they say they are willing to negotiate a settlement.

        On 16 May 2007 HMRC wrote to me saying this. (Many of you will have received the same letter)

        "Following advice HMRC now intends taking a number of representative cases forward for hearing at the Special Commissioners and possibly beyond to the Courts to establish the income is chargeable.

        At this point I am writing to you to see if you are prepared to await and accept the decision of the Special Commissioners/Court to settle your enquiry."


        A few months later they were working on BN66.

        If we're not careful they will stitch us up again.

            Totally agree. It seems to me that our best (only?) way forward now is to push towards the FTT as soon as possible. Anything else - settlement negotiations, reviews etc. - can happily go on in parallel, but we need the tribunal there to force HMRC to play by the rules and not drag things out to the point that they can get creative again.

              HMRC have lied to us and deceived us in the meetings we've had with them.

              They claimed that George was a special case. They denied the settlement was anything to do with TAA. That's not what George says, and we've got copies of PAYE notices HMRC sent to his Agency to back this up.

              They told us we were completely wasting our time with TAA.

              Now they come up with outrageous fraud allegations.

              Nothing they say can be believed.

                    Totally agree. The election will cause a bit of upheaval and might work in our favour, but the time to strike is now, otherwise a new extension to their powers will be announced in the Autumn statement. It is very clear listening to the various speeches that there is going to another round of labelling small businesses as tax avoiders and then using the momentum from public opinion to go after them. The new legislation for reporting PSCs is aimed at that, I'm certain of it. If we don't get this into the system before the next wave we are going to face an even stronger political headwind.
