If Morgan McKinley is found guilty, the case will be published along with the verdict. Actually even if they are nor found guilty, the case will also be published on their web site, and the public will know about it.
I'm surprised that it comes under the responsibility of the ASA - their website says
Companies' trading practices, contractual matters, the quality of goods and services, claims on packaging and trade names are all dealt with by trading standards.
So it's probably worth talking to trading standards as well as the ASA just in case. Make sure you have a copy of the advert somewhere - if it's online then they may remove it as soon as any sign of anything legal approaches.

Gather your evidence and stake your claim.

    Good luck to you.

Good for you OP although I dont think you'll get anywhere to be honest.

Soiunds like some right dodgy dealing going on somewhere. It is annoying when you get stitched up like.

Interviews these days for gigs seem to be more of a crap shoot than ever. I've had interviews where I've thought no chance and got the gig and I've had interviews where I;ve nailed it an didnt get.

So many things going on behind the scenes like have they got someone cheaper, is agency being greedy with their margin and making you look expensive, have they already got one of their mates in on the deal? Also, sometimes you get interviewers who focus on knowing the manual inside out (which is not me) and sometimes you get ones looking at overall package?

Total luck sometimes with client interviews.

As I mentioned that I complained to Advertising Standards Authority (ASA) on Monday, got a reply on Tuesday, and yesterday they asked for some clarifications and the ad from me and confirmed that they would launch an investigation. Quite unreal for their efficiency but it happened. So will see what that brings.

rightly or wrongly, list or no list, you won't be getting anything from that agency in the future if they find out it was you and ASA do anything.

That's not the outcome I would like to see. The situations are different between the two cases so will see what ASA's decision will be.

Morgan McKinley has now retained a law firm to represent them to deal with me, now they know I am serious and they are getting serious. Maybe ASA has already contacted them.

I very much doubt they give a stuff about the ASA. The ASA have pretty much zero power, except to ask that the advert in its current form isn't run again.
