    Portugese/Spanish Digital Nomad & UK IR35 Inside Contract: FCSA Approved Umbrellas

    Hi all,

    Need to pool some advice regarding recommendations for a FCSA approved umbrella company that can/could provide Umbrella services under the following scenarios.

    This is not a thread for the visas themselves, just recommendations for the FCSA Umbrella companies that are looking to provide these services for, contract workers looking to work under the new Spanish and Portugese Nomad Visas.

    Scenario 1

    Requires a FCSA Umbrella
    British National working in Portugal under extendable Digital Nomad Visa (November 2022)
    Not tax resident in the UK
    6 Month Contract with UK Company in GBP which is delivered remotely from Portugal
    Contract would be inside IR35 if delivered in UK
    Revenue >750 GBP Per Day
    Qualifies for Portugese 20% flat income tax rate under NHR 25 – Specialists in information and communication technologies (ICT)
    Requires money to be paid into Euro Revolut or, Equivalent Euro based bank account in Portugal.

    Scenario 2

    Requires a FCSA Umbrella
    British National working in Portugal under extendable Digital Nomad Visa (November 2022)
    Not tax resident in the UK
    6 Month Contract with UK Company in GBP which is delivered remotely from Portugal
    Contract would be inside IR35 if delivered in UK
    Revenue >750 GBP Per Day
    Qualifies for Portugese 20% flat income tax rate under NHR 25 – Specialists in information and communication technologies (ICT)
    Does *not* require money to be paid into Euro based bank account in Portugal.

    Scenario 3
    Requires a FCSA Umbrella
    British National working in Spain under extendable Digital Nomad Visa (5th January 2023)
    Not tax resident in the UK
    6 Month Contract with UK Company in GBP which is delivered remotely from Spain
    Contract would be inside IR35 if delivered in UK
    Revenue >750 GBP Per Day
    Qualifies for Spanish 15% flat income tax rate under Spanish Digital Nomad Visa programme
    Requires money to be paid into Euro Revolut or, Equivalent Euro based bank account in Spain.

    lucyclarityumbrella I know that Eek holds you in high regard, any information or, clarifications you could share on this would be gratefully received.

      Not possible to be done by any sane umbrella firm.

      Because Agency reporting means that the agency needs to tell HMRC that you are being via paid xyz umbrella for the work you do and HMRC will be expecting full payment for the money.

      If you wish to work from abroad as an overseas citizen not paying UK tax, you need to get the agency to agree to it so that your address is recorded as being abroad and they pay you that way.

      Now that's not to say that you won't find an FCSA umbrella willing to enter into such a situation (Pendragon / 6Cats might as they do more international stuff with international workers paid in that country) but if you find one could you let us know..

      however, I think in those cases you will be treated as a worker working in Portugal / Spain so would be subject to their employment taxes

        so kind, but I'm going to pass you the same bad news as Eek. If you are not tax resident in the UK, it is unlikely that any umbrella company offering standard PAYE umbrella will be able to help. You would need an equivalent brolly in the country you reside, which then won't carry FCSA accreditation.
