I would suggest its all agency staff, including I.T. bods, interestingly a lady agent for a large recruiting agency who specialised in NHS "IT BODS" contacted me yesterday (as I have worked for her in the NHS) saying she now specialises in permi roles (not NHS) and would I be interested in going that route, answer YES ! It never crossed my mind she wasnt doing it anymore because of this.
A national company like she works for dosnt just move someone aside with all the contacts she had.

NHS rates have tanked. Every conversation I have had with an agent of late has been the usual chit chat about the project/location before they say "Now as you'll be aware there is a rate cap at the moment so the client can only pay £190 a day....". God knows who they are going to find with these restrictions. To be avoided for the time being.

there will be an easy fudge for project - they simply state they need more senior band perm than they actually need, so normally a band 7-8a might be a PM, but they state they need a band 9 project manager - which is 77-98k basic, plus 55%
Circa £150k per annum, which is about £600 per day on 260 working days.
Fudge-tastic, and will only work with certain roles, but its a way round it for management roles within projects that will never have a perm resource.
VSM payments are exempt which take care of assistant Dir level and above, so maybe an issue for those that command a £700-£900 per day rate now as a senior manager that isn't at VSM level as they would fall in an area above a banded threshold +55% cap....
Maybe fixed priced contract?

The document seems to suggest it affects all agency staff employed by the NHS including non-clinical staff. It also mentions staff employeed through limited companies. Nothing in the document appears to suggest contractors would be exempt. If this comes in the NHS is going to struggle to get a lot of projects off the ground. In short as I read it, contractors can earn no more than PERM salary + 55%
its only a consultation, and as its about perms I assume applies to BAU roles rather than projects....but I'm not sure on that.
Ridiculous if it comes in.
Dear Interim Nurse - please accept a small premium over a perm to pay for your:
Bench time
Holiday pay
Sick pay
Indemnity insurance
Tax
NI
and while your at it hang around and wait for a shift which may, or may not need filling with 24 hour or less notice on shifts....

I can see hospital operations (and other provider operations) grinding to a halt.
