    Agreed. The idea is to re-design the scope of work. Also agree it won't be possible do achieve in every situation but it will work where one can identify a distinct scope of work - that may work for one individual, or may have to be at a team level where an individual's output can not easily be distinguished and contracted for within a team output.

  • One option to continue working in the PS, retain ltd status & work outside IR35

    As both a contractor and a buyer of services from other contractors in the public sector I have been following the IR35 developments over the last few months and taken advice. I have come to the view that if anyone is keen on continuing to work in the public sector, retaining limited company status and working outside IR35, one option to consider is to re-focus the terms of engagement on outcomes.

    We are a small consultancy working with a wide group of associates, all limited companies. We work across both the public and private sector either putting in teams or just individuals on engagements. I am a joint founder and I myself am delivering engagements as an individual and/or managing teams to deliver work at any one time. Whether we are deploying individuals or teams into the private or public sector we work with our clients to shape engagements. The engagement outcomes are the focus of our services and the benefit our clients will receive. Of course there are cases where our associates are known to and well-loved by our clients and so are continually in demand to extend. However again, rather than simply allowing them to be re-contracted on a time and materials basis we invest our time to re-specify an outcomes-based statement of work. We will continue to deliver engagements like this in the public sector post April 2017 that will remain outside IR35.

    I am happy to extend our approach to anyone currently delivering business change & transformation work in the public sector. We have market access pan-government via frameworks that are not contingent labour or manpower substitution-related. Do please get in touch if this is of interest.
