Being realistic, when these are offshore schemes, deliberately set up to obscure just about every aspect of their existence, I would assume that number one priority from the very outset would have been to ensure minimal chance of redress from the UK legal system. I really don't think I could perceive any reasonable chance of justice being served. I am a bloke in the street, what do I know? But I do think the people who set these scams up were likely very careful to ensure their activities were going to remain out of reach of the law, forever.

I will settle as unfair as it is as I have no other options. As painful as it is it would soften the blow if i know this scheme provider felt the full force of the law and prosecution

If anyone can find an actionable cause of action against the promoters then I think everyone affected regardless of scheme and the financial outcomes would be happy to join. The problem the grounds for that action and the enforceability.

We aren’t aware of Smartpay’s recent announcement.

Are they associated with AML or Procorre, or is it a separate announcement?

    Edit: oh, I see... https://forums.contractoruk.com/hmrc...-smartpay.html
