XOR
I would advise everybody to have nothing to do with any future incarnations of XOR, I worked direct for them several months ago and they stalled when it came to paying, understandably as it transpires from speaking to the administrators that they knew they were going to the wall, and yet the directors were still milking the company. I've lost 5K, many will have lost more. They are crooks, and if they wish to sue me for libel, they are welcome to PM me for contact details. I will be very happy to oblige.

XOR Professional Services in administration
I have been contracted by a UK branch of a US company via XOR and my payments are in great danger because XOR has gone into administration. If there are more people in this position, I would like to see what we can do. One thing I would like to have examinated is the responsibility of my end client, so the company that involved XOR for the timesheet and invoicing process (it didn't know them until the company that contracted me pushed them forward for the two projects I have been doing).

As others have said you need to look at your contract, technically whoever your contractual relationship is with is responsible for payment. Unless you have a "we pay when we get paid clause" included in the contract.Originally posted by bobsa View PostI was contracted to the end client through an agency to XOR, the agency called me today to say payment wouldn't be forthcoming, however, my contract is with the agency so going to push them for payment.
Don't really know where I stand though.

Most contracts have a clause in them which says that if they don't get paid, you don't get paid.Originally posted by bobsa View PostI was contracted to the end client through an agency to XOR, the agency called me today to say payment wouldn't be forthcoming, however, my contract is with the agency so going to push them for payment.

As DaveB says, though, if you are opted into the agency regulations, then they have to pay you whether they get paid or not. So, if you didn't opt out of the agency regulations, in writing, before being introduced to the client then the agency have to pay you.

If you were opted in they have to pay you regardless.Originally posted by bobsa View PostI was contracted to the end client through an agency to XOR, the agency called me today to say payment wouldn't be forthcoming, however, my contract is with the agency so going to push them for payment.

Not the first time its happened...
I dont think this is the first time this has happened with XOR, if you do a check up on the directors you'll see what companies theyve run previously and dissolved ..!!Originally posted by bobsa View PostI've also just been bumped by XOR, not a happy chappy.

XOR Technology Services Ltd is a brand new company, incorporated on June 3rd this year. It looks like they've sunk the old company and immediately started trading via a new Ltd co.Originally posted by baronne View Postthey're now called XOR Technology Services Ltd. - steer clear.
Perfectly legal, if somewhat morally dubious.
Fill out the claim form when it arrives from the administrators only takes a few minutes, but don't hold your breath for any pay out. As the administrators get paid first!

Incidentally, PCG Pus has just gained some extra freebies, agency default cover is extended to clients going under and you can get some sick pay as well...

.....other than that, think I will take a look at the extra freebies now

Probably a good diea to get it now then?Originally posted by baronne View PostUnfortunately I don't have PCG cover, and only knew about PCG cover about a month ago and checked the conditions state that when you get cover it can't cover previous dealings and not for the first 60 days of cover...
