If you were contracting in the same geographic area before this contract you could already be over the 24 month rule. London is mentioned in the HMRC literature specifically.
NLUK I have to ask - what's with all the numbers??????

You get a 10% + saving for buying an annual ticket - and you get the whole year at 2012 prices although you are mainly using it in 2013. Given that prices are going up by 6% next January, this all adds up.

I don’t why I didn’t think of the refund option! that’s is the simple answer. I have checked the London Midland site and it is allowed

Simply because if the service is really screwed up they give season ticket holders a massive discount on renewal of the ticket.
As long as you are clear about why you acted that way and put it in the accounts then I don't see how it's a problem.....

So say you buy a 1 month season ticket from Manchester to Euston (£1200 for arguments sake) and the cost of a Standard Day Return is £200, the season ticket is worthless after 6 days (6x £200 = £1200).

I only bother with 1 month at a time, just in case, you know, I want to leave.
And if the money is that important, just get a higher rate
