Just working on making the agency toast now.
My solicitor is in the process of writing them a letter advising me that they know didly squit about contract law.
The contract says £x for further renewals. I have email confirmation of that stating that the client is likely to renew and that I'll be on that rate going forward.
Agency reckon:
Ahhh, but that was before the recession...
Ahhh, but that was when we had lots more people on site, hence could take the hit...
Ahhh, but that's when the sky was blue, today it's grey (OK I made up this one)
Interestingly enough, they want to negotiate only by phone i.e. nothing in writing. Do they take me for a fool?
I'm giving them 2 choices;
They can release me from my current contract
They can continue to pay me at the agreed rate
Otherwise they will be deemed in breach of contract

They can refuse to honour their promise to maintain your rate. In which case, they have voided the contract. If they pull you off site - in effect, remove your services from the client - you simply go direct. They won't be able to apply a handcuff clause since it was they who stopped the contract. So assuming the client is on-side, let the agency go ahead.
Just make sure that either the client will take you direct, or you have a tame agency they will be happy to use; at a very low markup of course.

The Saga continues...
So now they wanna make £7/hour out of me - £250 a week? for what?
They're trying to stir things up with clientco.
I've told them they can swing for a rate cut. I've shown them the email where they've stated that my rate will stay the same through any subsequent renewals. I've told them that they're going to be in breach of their contract should they try anything further to reduce my rate. They're still threatening to pull me off site.
Clientco want me to stay, I'm happy at the minute to stay.
Just called my solicitor and will be seeing them on Tuesday....
Is there anything (other than use of 12 bore shotgun) that I can use to make these people get the hint!

The found me the gig, they left me alone, they pay their invoices on time. Just what I wanted from an agency.
But this is the last time I work through them. They've shown themselves in their true light.
And as for taking it up the ladder? Well the lass that fixed me up with the position has been released. Her boss, that I spoke to a couple of times is also no longer there... After a rather heated phone call with the jerk at the agency today, I'm just starting to calm down a little....
"We're going to issue clientco with a notice of termination, 60 days then pull you off the job, are you OK with that?"
No
"But we're not making any money out of you"
How is that my problem?
"But if we're not making any money out of you, then we have to pull you off the site"
Have you got another role for me?
"No, it's a bit quiet out there"
So you want me to sit at home twiddling my thumbs? I assume that you're going to pay me my full rate for this?
"Well no, actually if you're not working we can't pay you!"
So, the client wants me, and is happy with the rate agreed with you?
"I can't say as I haven't spoken to them"
No, I'm telling you that as a fact because I have spoken to them.

And, as I have no immediate desire to become one of the three million, as long as the client wants me, and is happy to pay me and I'm happy to stay, I can't see me packing my bags and leaving just because your company made a bum deal.

And you do realise that you have 10 other contractors on site?
"yeeeeeeaaas?"
And you're thinking of p1ssing clientco off over one contractor, when there's three other agencies on the preferred suppliers list?
"I wasn't aware of that.... I thought we had exclusivity"
You thought wrong!

I got something like 168 connections to my Richard Cranium id on LinkedIn before The Management twigged and completely culled my existence. THAT's how meaningful a large number of LinkedIn network connections is.
I had an interview lined up with a USA magazine journo who had worked it out and contacted me quietly about it.
(Quite why a bunch of other people then created accounts with the same name, I cannot imagine. Someone has even re-cycled the RichardCranium shortcut.)
