Why not resolve it direct with client. If client says agent cannot supply you then there is zero demonstrable loss. Ask client to put you through a different agency and get on site asap.

Don't know who told you that but no you haven't.
If you've got IPSE+ you might be able to claim against their business interruption offering but that's limited to 2k max but that's all you can do.

This is exactly the position I am in now and they cannot resolve it between themselves
Turned down another offer as this was just waiting paperwork (they said)
So I am stuffed now looking again and no I am not a newby to contracting just fell for the crap given by agencies.
Told I have a very strong legal case if I want to pursue loss of earnings as offer made and accepted but will cost thousands

If the Agency you went with is on the PSL for Permie, I doubt they would want to lose a business channel and would probably allow you to go via another agency.
Also, if they are an unable to agree terms with the company then they would not have made any money off you, they couldn't agree. Therefore, you could argue you were free to go through another agency. This isn't the case that you were with them and you got nicked by another agency and cost them the commission for the duration of your contract.
Lastly, get to the point, the amount of times you repeated yourself and made the post much longer than it needed to be was shocking!

Yes that is one difficult to read post!
Long and short of it is, if the client wants you badly enough then it's up to them to deal with the fallout with this agency, but if they really don't have an agreement in place to supply contractors then I don't see how the client could be in breach of it, and therefore no issue with you signing up via another agency.

Given the Director wants the OP, then it makes sense for the OP to be up front with the Director and say what day rate he was promised.
