Not sure how 2) would affect it but the 3 month break wont help. Read the rules.

I'd include a strict early termination clause in the contract, if it was me.
Assuming that there is a "normal" notice period in there (let's assume client has to give you two weeks notice), then there is nothing to prevent them from turning round just before the contract starts (when you've turned down work because this is coming) and never starting the contract.
Penalty for early termination (not a paid notice period for doing no work) and a penalty for late start (nothing to prevent them from pushing back the start forever) would be my minimum, unless you're getting some other benefit by making yourself available for the client.

Yes, HR at this clientco clearly want to show numbers and hence they are insisting upon this three month rule. Thanks for the reply though.

I suppose there' s no point in trying to educate Human Remains about the nonsense of the 9 months in a year ruling, which has no basis in employment law or commercial reality. Still, I suppose HR have to justify their existence somehow (and they could always try reading this guide, a bit old but still perfectly relevant)

Through an agency. The client chose me and put me through one of their agencies. It will still be through the same agency (1 week payment terms and no restrictive covenants, if it helps.)
