Contrary to popular belief you are not automatically covered by the regulations if you haven't opted out. That depends on whether you're controlled by the client. If you want to be covered by the regulations should have it in your contract, then there is clarity. Then again it would have been easier just to strike out the handcuff clause.
I wouldn't rely on the regulations to get you out of a handcuff clause. Either take your chances or sort something out with the agency.

Why not go research exactly what the regs are so you will not only be able to answer this question but any other thing you might be unsure of. Might find something else useful you didn't know about.
