HMRC enquiries for Schemes through ASMG / White Collar

      Feb 2013. Yeah I got a CLSO in 2014.

          Thank you for the reply. I have seen the connections between myFD and WC in the posts. My question was to see anyone else has taken this or any other option and to see what the general consent here is. I am struggling to take a decision on whether it is worth spending another £1,200, especially when I am a not a contractor anymore (Hence money is tight). The main points are ...

          1. Do you think HMRC will continue to pursue this, especially in light of losing court cases?
          2. What if we didn't get help from myFD or someone similar?
          3. Would WC will continue to help? (Very unlikely, from what I can read)

          I haven't got any letter saying Accelerated Payment Notice. Had two letters, one showing I owe them money. The second one is the CLSO.

            Your questions - my opinion

            1. Yes
            2. You could wait and see and get the final result of the litigation or HMRC's unchallenged analysis if the litigation fails to get to Court and nobody is fighting your corner.
            3. No comment

            A "letter showing that you owe money"? It probably says more than that.

            The CLSO letter means that you are very definitely on HMRC's radar.

            You won't get an APN because WC was not disclosed. Again I offer no comment as to this surprising fact.

              Thank you again. I din't quite understand what you meant by this statement. I spoke to WC when I got my first letter and as per their reply they suspended it. There was no news over an year, until I get the CLSO, which is the last letter I received.

              Though, based on your answers looks like it is better to get an expert on side.

                I meant that WC was not so very different from other schemes, but it was not disclosed under DOTAS and others were.

                There may be a good reason for this.

                If however it is eventually found that it should have been disclosed, then the failure to do so could bring penalties on provider and perhaps users.

                  That throws an interesting question. Hmrc have included WC years in the CLSO which isn't DOTAS registered so they are unable at the moment to follow that up with an APN once the June deadline passes. What do you think will happen? A FN as soon as a similar scheme bombs in court?

                    Possible.

                    Perhaps they may challenge the non disclosure and argue that it was a notifiable scheme.

                      You misunderstand. I don't know where I stand. I got the assessment and let WC advise me - I did absolutely no investigating whatsoever. I have absolutely no idea what my options are or what the chances of my being forced to pay are - I don't have a clue. I am no wiser than anyone who received their assessments yesterday !! Hence why I joined this board ... so I can get some answers.
