    Its gr8. HMRC should add some more liabilities to the list NI, IHT and what else they can think of. It just mate settlement an opportunity for mentally retarded. I guess 65000 bankrupt and not able to work will do wonders for the government.

      65000 bankrupt? I'd be surprised if it's 65. There isn't a single good reason for then to bankrupt people. It works against them. It costs them. They have to get a judge to agree. You would need to have no assets. You would need to show that your incapable if warning to pay something. I'm not convinced they'll force sales of family homes. I think they will go for any kind of payment they can get. That's what they're selling to the general public.

      I'm in a position of not having funds and I doubt they'll agree to TTP for the length I need. If they wanted to enforce TTP of a length and severity that would tie people down for an unacceptable time frame then you can bankrupt yourself. That's what voluntary bankruptcy is for.

        HMRC don't care what happens as long as they get their money. Bankruptcy, families destroyed, lives ruined ... it's all in a days work for them - they relish the challenge. A handful of suicides along the way and they'll be looking forward to some extra inheritance tax - the icing on the top to be used to pay a bonus or two

          ...not sure that's the case. Insolvency practitioners I have spoken to think HMRC would be on dodgy ground bankrupting you before your case has come to tax court. Legislation may state that the tax is due, however once bankrupted you would be unable to fund a defence and even if you could and won - the HMRC offered redress would not adequately cover the impact of the bankruptcy.

          It's a mess. They know it, so they're asking us to settle.

              hi everyone.
              i have found my way back to this site/thread as this morning i took delivery of the "Contractor loans settlement opportunity" letter as well. I was a member of the scheme from 2005 to 2006 only and i remember appealing via Edge back 2010, so i thought this had all gone away..

              i see this thread is 107 pages long and thats a lot of reading, so can anyone point me to the most important posts, or advise me of what type of response i need to make and are there other time scales apart from the 9th january 2015 deadline that i need to be aware of?

                Hi cshylock, same as me. Basically I was using Norla - they changed to using Edge Consulting in 2005/06 and the EBT scheme and that was that. I had contacted Edge Consulting too when the HMRC investigation started and was told that everything operated to then current legislation. I have been trying to look through the posts too and would be grateful for someone to summarise the present situation and what response it is advisable to make.

                At the beginning of this thread it is mentioned that people should appeal - is this still the case? and If so is the deadline for appealing 9th January 2015?

                  HMRC are offering you am opportunity to settle, I.e.pay up all the tax they think you owe, plus interest.

                  This is not something that needs action from you unless you wish to settle. Appeal letters are talked about in this thread for those people who have received personal reassessments with an actual amount due.

                  If your scheme was DOTAS registered and your scheme is on the list HMRC published recently, you can expect an APN at sone point in the next 20 months. This cannot be appealed.

                  Read, research, and read some more until you understand your situation.

                    Hi ImFedUP, actually after further consideraton (its a long time ago!) i remember i switched in 2006 from Norla consulting (ebt scheme) to edge consulting umbrella scheme. So i am hoping from 2006 i dont have this issue pending in my tax affairs.
                    After some initial conversations with tax accountants i have quickly realised that not many specialists in the field fully understand the EBT scheme design that Norla employed and its proving hard to find advice from anyone who actually who really knows what they are talking about.
                    Does anyone have experience of the Self help group/ s29ers ? i stumbled across their site in the early hours and i am not sure if they are legitimate and useful or not.
                    Any advise is warmly recieved...

                      I'm keeping out of these threads at the moment but its worth adding an explanation to the bit in bold above for those who arrive here without the recent background.

                      For those who don't know APN (Accelerated Payment Notices) were introduced in this year's budget. The argument is that HMRC would like to hold the disputed money while it is disputed rather than the taxpayer keeping it.

                      As such you cannot appeal an APN as your dispute remains ongoing HMRC are (merely) asking for the money now so they can hold it for you until the dispute is resolved.
