HMRC enquiries for EBT schemes through SANZAR

So it seems a few lucky individuals out there have been hit with 12-13 Self Assessment enquires in the 11th hour.

Obviously HMRC are fully within their rights to enquire within the 12 month window, however how have people been responding ?

I know that HMRC are requesting bank statements, loan details, scheme information and everything else. I'm just curious as to what people have actually been sending them and what if anything HMRC have responded with.

What's everybody's take on this ?

Are these formal enquiries, i.e. do people have to respond with anything?

Yes, they're Self Assessment compliance checks, so i doubt anyone would be doing themselves any favours by ignoring them.........

Not sure of the legal stand on it, but seeing as HMRC are 100% entitled to open the enquiry within the 12 month window, I doubt taxpayers would have much clout in refusing to co-operate.

I've heard of cases where CH are telling people just not to respond......that's just idiotic. You can't just ignore official (and legal) requests for information from HMRC.......well you can, but at your own peril !

I think it depends on how the scheme is set up. EBTs were there to benefit employees - I guess these schemes don't have employees. The downside is that the scheme has no obligation to give you money and, as such, could just keep it.

Don't think Sanzar were going in that year. I know some promoters are liaising with the HMRC on behalf of their 'members' on what to supply have agreed an extension to respond.

I wasn't in any arrangement post 2009, but have received a Section 9A Enquiry for 12/13.

"I should like to consider the return in more detail and investigate the contractor loan arrangement"

My answer to their 10 points was basically - I was not in any loan or arrangement x10.

There is no - You "might" have been in a scheme - It is Guilty b4 you categorically prove them wrong!!

I asked them for proof or reasons as to why they think I was in a scheme. I won't be holding my breath.

Am LTD now btw.
