    Could be nasty...........

    Time's almost up for 16,000 tax scheme contractors :: Contractor UK

    Does anyone know whether this would apply to people who are already in receipt of discovery assessments and who have already appealed ?

      Given this statement in the consultation doc "Proposals to require individuals and companies to pay the tax in dispute
      during an enquiry or appeal relating to tax avoidance." I would say Yes.

      A main driver for this move is to expedite the collection of monies from the likes of ourselves and I can see it happening asap this year once the proposal is legalised.

      Time to start mustering the cash and/or your tax advice....

        I'm sick to death of HMRC with their high and mighty approach, and the way they insist that everybody is a criminal.

        In this country the law clearly states that an individual is innocent until proven guilty. I'm not even sure how it can be legal to demand money from somebody, when you cannot legally prove it's owed.....if you or I did that we would be arrested.

        It took HMRC 9 damn months to even reply to a letter I sent them, so why the hell should I be in ANY way helpful to them.

        If this gets rubber stamped as law, then how long will it be before we start seeing stories about lives being ruined where HMRC got it wrong.

        Seriously......if that's what happens I'm tempted to take all my money and assets and move abroad, go bankrupt and then come back in two years......and ill make sure I take HMRC for a damn site more than I 'apparently' owe them now that's for sure !!!
        I know it is wrong and denying basic Justice but instead of getting all upset about it
        1) Think and get involved. Reply to the consultation document and get you point across
        2) Spread the word and get other contractors and Professional bodies involved

        Contractors today are just the scapegoats for HMRC for the faults they have done. Many Politicians will like to burn us publicly to get votes from those not affected. We all need to respond and get together.

            I have left my feedback.

            This is infringement to one's basic human rights - EBT schemes are/were not/never criminal acts.

            At the moment, politicians can portray themselves as heros for eliminating the basic rights from EBT users which makes me physically sick.

            Come on people, hold your nerves and direct your attention towards this consultation.

            It may be worth, getting media's attention to propagate this agenda further.

            What are your thoughts?

              These proposals (legislation) would have to be passed by Parliament, so it's not just up to HMRC.

                Fair point, but lets face it, Parliament are hardly sympathetic to anybody who they perceive are 'tax dodgers' in their eyes.

                So the consultation closes on Feb 24th, does anybody know what happens then ? IE at what point this 'plan' could or would be put before parliament, and then assuming it was successful at what point it would actually be enforceable.

                To apply this to cases already in dispute is 100% retrospective. So I wonder what happens if people won't/can't pay. I assume HMRC would not be able to try and make you bankrupt for a debt that they have not actually proved is due.

                HMRC truly are backward in their thinking. Instead of trying to work with people to sort these issues out, they just try to strong arm them. This just makes me even more resolute to ensure that I never pay a penny more than is legally owed, including ensuring all assets are also firmly out of their reach.

                  It would be debated in the Finance Bill Committee in May, then passed into law in July.

                  Over the summer HMRC could start issuing payment notices.

                  We (NTRT) won't be taking this lying down.

                    Sanzar HMRC Discovery AFTER AN APPEAL IS MADE

                    Hi

                    Looks like everyone is getting these Sanzar letters from HMRC re self discovery claims for EBIT Tax. I wanted to confirm in their letter it states that INTEREST WILL CONTINUES TO BE CHARGED ON ANY TAX THAT IS POST-PONED. This doesn't seem right as what happens if it takes a year for the appeal to be looked at that's a year worth of interest.
                    Also has anyone had there appeal progressed at all and the result. How long did it take.
                    Do you think if will ever be waived completely the appeal or the amount just reduced?

                      Had the letters as described previously in this thread for tax years 08-09 and 09-10 when I was with Sanzar (both came through at different times in 2013). I have appealed / postponed both via Contractor Helpdesk / Cobham Murphy and was leaving them to have discussions with HMRC, however the latest update from Contractor Helpdesk on Thursday (30th Jan) has concerned me slightly so I've come online to find out more information and stumbled across this thread. If nothing else it's "comforting" to find other people in the same boat.

                      In the update in mentions the Rangers tax case as being a stick that HMRC will use to beat us with if they win, but earlier in this thread someone mentioned they are 2 different cases - is that correct?
