    Sounds about right.

    This is going to go on for years I reckon.

    Have any assessments relating to BN66 actually been settled yet (ie have HMRC actually forced anybody to settle) or are these still dragging on ?

      150 people settled in 2003. Another 250 have settled more recently, probably voluntarily.

      The remaining 2000+ cases are still ongoing, with tribunal test cases still yet to be heard.

          FACTS!

          - HMRC are watching these Threads closely
          - SANZAR was not an EBT
          - SANZAR was lawful up until new laws come in until which time it closed
          - If the HMRC had anything they would issue a closure notice and take 1000's of people to tribunal (How they could do this I dont know) and get the money they believe is owed.
          - THESE LOANS ARE LAWFUL AND REPAYABLE!

          WHO SAID YOU CANT REPAY THESE LOANS? HOW CAN THEY NOT BE DESCRIBED AS LOANS OF YOU ARE REPAYING THEM???? COMMON LAW PEOPLE!

              There are still a lot of schemes around, many purporting to get around the Dec 2010 disguised remuneration legislation.

              IMO, these are really waving a red rag to the HMRC bull.

                Here's a question....

                Does anybody know whether HMRC have actually taken anything to court/tribunal at all, and whether anything has moved forward at all with the 08-09 (or earlier) assessments people received ?

                Seeing as HMRC in all their wisdom are so sure people owe them money, they don't seem very keen to push the argument and actually try and get it do they..!

                You hear of them challenging the odd person, but I've yet to hear of them actually going head to head in relation to any scheme that was used.

                Of course I could be totally wrong

                  It will be a long time before anything gets to tribunal. Even if HMRC were in a position to take a case forward now, there's a huge backlog in the tax courts to contend with. It could take a year or more, from when an application is made to the first-tier tax tribunal, before a case is heard.

                  This will likely drag on for years.

                    I agree it's going to take years and years before it goes anywhere.

                    What i'm keen to know though is whether HMRC have actually managed to make users of ANY of the so called schemes pay up, or whether all of them are still in limbo.

                      The only way HMRC could make (ie. force) people to pay up is by taking it to tribunal and winning. If that had already happened then it would have been reported in the professional press.

                      However, I suspect a fair number of people won't have appealed the assessments and will have coughed up voluntarily.
