HMRC Enquiry letters on Loans from EBT and other schemes

    To anyone that has received a calculation of tax owed, etc, did you receive this letter first? Or have we got two different things going on here?
    A few of the letters here (certainly mine) are a notice of assessment from 2008/2009 unprompted and not in response to any request for information.

    I believe as in your case some people have received requests for information; certainly based on others comments on this post. I am not sure if the difference in correspondence received is related to the schemes that people were using.

          A quick word on this - I spoke to Julia at Castlemaine, and she said they are accountants specifically engaged (by Horizon) to defend the Horizon contractors only. Therefore, it is not relevant to those of us in the Talent Resource Management, Sanzar, Norla, etc. case.

          I also spoke to Cobham Murphy and it appears they are inundated with requests at the moment, and they referred me to a mailbox to direct my enquiries to. My search continues to find someone I feel comfortable with to defend this...

            There have been two recent letters from HMRC recently, the first asking for details of loans received in the year 10/11, and the second more recent one where they state that the loans received in 08/09 should be taxed as income, with demands for payment. As Donkey Rhubarb says, the second is a massive try on by HMRC to try to scare people into coughing up.

              Hi,

              I'm in the same boat. Received the dreaded brown envelope this morning from HMRC demanding payment of Income Tax for the Year 2008/09. I was with TRM for that year. Agree with the posters who say we need to unite to take on the HMRC. Guessing that template would be a good start if anyone has gotten hold of it?

                I am a first time poster and the reason I am here is becuase I fall in to the second category here. I am keen on joining any group that are willing to pool funds to fight this.

                I have spoken to the PCG helplines and they also think its a bit underhand by the HMRC. So we have to appeal.

                I was with Talent Resource Managment and it seems HMRC know exactly how much money came to me via the loans scheme and not included in PAYE, they've calculated it to the nearest pound. So I would think they have information of every payment on everyone on my particular scheme. The PCG thinks they only go back to 08/09 tax year as the 4 year limit is approaching which runs out at the end of this tax year. Beyond 4 years he says something along the lines of them not being able to raise a discovery unless there was illegal behaviour. My personal accountant isnt so sure on this matter. There are also no fines on the letter as we are not being treated as crooks or people who have done anything wrong. Perhaps this is becuase they know legally we have not.

                  The process he described was that the initial step is to write the letter saying that you disagree. Then they will typically write back asking for more information. You will then write back with evidence relating to your employment and of the loan. And then it goes back and forward until you reach an agreement, they give up, or you go to court. He agreed to provide me a template for the initial letter for free.

                  A side note to this, I have noticed on the Tax Talk UK website, that although they say they are a different company from Raingold, that they share the same address. I'm really not sure what the arrangement is here, but I am interested to know Cobham Murphy offer to help you for free? Or is that the initial letter only, and then you have to pay?

                  It would appear that Raingold UK Ltd and Tax Talk UK Ltd not only have the same address but have the same two directors.

                  So as Raingold UK Ltd are acting for Talent Resource Management then surely they have an obligation to help, even if it is only a moral one, and engage Tax Talk UK on our behalf?

                    It almost warrants a response telling them to **** off.

                    I wouldn't be surprised if we see more dirty tricks, since I am yet to be convinced that they have any appetite to take this to court. Scaring people into submission will be their primary objective.
